Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and services operated by Mint Condition™ LLC (“Mint Condition™,” “we,” “us,” or “our”), including our AI pre-grading software, digital vault, batch and bulk workflows, and related tools (collectively, the “Service”). By creating an account, purchasing credits, or using the Service, you agree to these Terms and our Privacy Policy.

1. Who May Use the Service

You must be at least 18 years old and able to form a binding contract to use the Service. By using Mint Condition™, you represent that you meet these requirements and that all registration information you provide is accurate.

The Service is intended for collectors, dealers, and hobby professionals evaluating trading cards and related collectibles. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2. What Mint Condition™ Provides (Important Disclaimer)

A. Pre-Grading Estimates Only

Mint Condition™ provides AI-assisted pre-grading estimates, condition analysis, and inventory tools. Our outputs are not official grades from PSA, BGS, SGC, CGC, or any third-party authentication or grading company.

You acknowledge that AI assessments may differ from human graders and that final grades from official grading services are outside our control. Mint Condition™ makes no guarantee that a card submitted to a third-party grader will receive any particular grade.

B. Pricing & Market Data

Estimated market values, pricing suggestions, and valuation totals are provided for informational purposes only. They are not investment, tax, or legal advice. You are solely responsible for pricing, listing, and selling decisions.

C. Service Availability

We strive for reliable uptime but do not guarantee uninterrupted access. Maintenance, model updates, third-party outages (including cloud hosting, payment processors, and email providers), or force majeure events may affect availability.

3. Accounts, Credits & Payments

A. Credits

Most grading actions consume prepaid credits. Credits are deducted when a grading job completes successfully according to our published rules. Failed jobs, timeouts, or processing errors should not consume credits, but we reserve the right to investigate abuse or fraudulent submissions.

Credits are non-transferable, have no cash value, and are not redeemable for currency except where required by applicable law. Unused credits may expire or be forfeited upon account closure as described in our policies.

B. Purchases

Paid credit packs are processed by third-party payment processors (e.g., Stripe). By purchasing, you authorize us and our processors to charge your selected payment method. All fees are stated in U.S. dollars unless otherwise noted. Taxes may apply.

Refund requests are handled on a case-by-case basis. Contact hello@mintconditiongrading.com if you believe a charge was made in error.

C. Free Credits & Promotions

We may offer promotional or welcome credits at our discretion. We may modify or discontinue promotions at any time.

4. Your Submissions & License to Us

When you upload images or other content (“Submission Data”) to the Service, you represent that you own or have the necessary rights to submit that content and that it does not violate any third-party rights or applicable law.

You grant Mint Condition™ LLC a worldwide, perpetual, irrevocable, royalty-free license to host, process, reproduce, analyze, and use Submission Data—including for machine learning, model training, quality assurance, and service improvement—as further described in our Privacy Policy and Model Integrity Protocol.

Upon account deletion, we will remove personal identifiers associated with your account as described in our Privacy Policy. Anonymized Submission Data may remain in our systems for training and benchmarking.

5. Acceptable Use

You agree not to:

  • Use the Service for unlawful, fraudulent, or abusive purposes.
  • Attempt to reverse engineer, scrape, or overload our systems or models.
  • Upload malware, illegal content, or material you do not have rights to use.
  • Share account access or resell credits in violation of these Terms.
  • Misrepresent Mint Condition™ outputs as official third-party grades.
  • Circumvent credit deductions, rate limits, or security controls.

We may suspend or terminate accounts that violate these rules, as described in Section 8.

6. Intellectual Property

The Service, including software, models, branding, documentation, and UI, is owned by Mint Condition™ LLC or its licensors and is protected by intellectual property laws. These Terms do not grant you any ownership interest in the Service—only a limited right to use it according to these Terms.

“Mint Condition™” and related logos are trademarks of Mint Condition™ LLC. You may not use our marks without prior written permission.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINT CONDITION™ LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that AI outputs will be accurate, complete, or suitable for any particular purpose, including decisions about third-party grading submissions or inventory purchases.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINT CONDITION™ LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR INVENTORY VALUE, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MINT CONDITION™ IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

9. Indemnification

You agree to defend, indemnify, and hold harmless Mint Condition™ LLC from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your Submission Data, your violation of these Terms, or your violation of any third-party rights.

10. Suspension & Termination

We may suspend or terminate your access at any time if we reasonably believe you violated these Terms, pose a security risk, or engage in conduct harmful to the Service or other users. You may delete your account at any time from your Profile page.

Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive (including licenses to Submission Data, disclaimers, limitations of liability, and indemnification) will survive termination.

11. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except where preempted by applicable federal law.

Any dispute arising from these Terms or the Service will be brought in the state or federal courts located in Colorado, and you consent to personal jurisdiction in those courts.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the “Last updated” date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
